MTB Here is provided to you as a private service of Millennium Tower Boston.
These terms exist so that residents, guests, and staff can use the App and
web portal with clarity — they describe what we offer, what we expect of
you, and what happens when things go wrong.
Acceptance of these terms
These Terms of Service (the "Terms") are a binding agreement between you
and Millennium Partners Management LLC ("Millennium,"
"we," or "us"). They apply to the MTB Here mobile application, the
companion web portal at mtbhere.com, and any service we deliver through
them (together, the "Service"). By signing in to the Service, you accept
these Terms and our Privacy Policy.
If you do not agree, please do not use the Service. Decline of these
Terms does not affect your underlying residency at Millennium Tower
Boston, which is governed separately by your unit's purchase agreement
or lease.
Who may use the service
The Service is offered to:
- Registered residents of Millennium Tower Boston —
owners, tenants, and authorized occupants who appear on the unit's
registration with the management office.
- On-site staff — concierge, front desk, engineering,
valet, and amenity team members, while acting in the course of their
duties at the Tower.
- Designated proxies and guests — only where a resident
has explicitly granted access through the management office or through
an in-App invitation.
You must be at least 18 years old. We may verify your residency at any
time and may decline or revoke access if we cannot.
Your account
You are responsible for keeping your sign-in credentials confidential
and for any activity that occurs under your account. Sign-in is available
by email and password, Sign in with Apple, Google Sign-In, or biometric
unlock on a paired device. If you suspect your account has been used
without your permission, contact the management office immediately so
we can suspend the session and reset access.
New registrations are reviewed by management before activation. We may
ask for verification (a copy of a lease, a recorded deed, or a written
authorization from the unit owner) before approving access. We may
decline a registration without explanation; in practice we decline only
when residency cannot be confirmed.
Acceptable use
When using the Service, you agree not to:
- Impersonate another resident, guest, staff member, or vendor.

Submit false, misleading, or harassing requests to the concierge, valet,
engineering, or amenity teams.
- Use the Service in any way that interferes with another resident's quiet enjoyment of the building.

Attempt to access data, accounts, or features that have not been
granted to your role — including any attempt to circumvent
authentication, role checks, or rate limits.

Reverse-engineer, decompile, or extract source code from the App or
web portal, or attempt to scrape or bulk-export resident data.

Upload content that is unlawful, infringing, defamatory, obscene, or
that contains malware.

Use the Service to advertise, solicit, or distribute marketing material
to other residents without written authorization from management.
- Use the Service for any purpose outside the operation of your residency at Millennium Tower Boston.
We may remove content, revoke a session, or restrict features at any
time to enforce these Terms or to protect the safety, security, or
quiet enjoyment of the building.
Services we deliver
Through the Service you can reach concierge desks, submit valet
requests, RSVP to La Vie events, view the FLX class schedule, book
amenities, listen to the resident podcast, read newsletters, and sign
building documents (move-in packets, amenity waivers, lease addenda,
and policy acknowledgements).
Service availability follows the building's operating schedule — the
concierge is staffed 24 hours; engineering, amenity, and management
functions follow posted hours. We aim for high uptime but do not
guarantee uninterrupted availability. Planned maintenance is announced
in advance through the App; unplanned outages are restored as quickly
as practical.
Documents signed through the App are processed by DocuSeal and stored
in our secure vault. A signed PDF and an audit log are made available
inside the App after signature; the building also retains a copy for
the duration of your residency plus the retention period set out in
the Privacy Policy.
Third-party vendors
Some features open a secure in-App browser to a trusted building vendor —
BuildingLink (deliveries, work orders), ValetPlease (vehicle requests),
and DocuSeal (e-signature). Your use of those vendor sites is governed
by their own terms and privacy policies, summarized in the
Privacy Policy. We are not responsible for the
availability or accuracy of third-party services, but we will make a
good-faith effort to address any failures that affect resident
experience at the Tower.
Content you submit
You retain ownership of any content you submit — profile photos, event
RSVPs, dietary or access notes, service requests, comments to staff,
and documents you upload for signature. By submitting content you grant
Millennium a limited, royalty-free license to display and process that
content as needed to deliver the Service and to retain it consistent
with the Privacy Policy.
You are responsible for the accuracy of the content you submit. We may
remove content that violates these Terms, that is reported to us as
inaccurate, or that creates a safety or compliance concern.
Fees and charges
The Service itself is provided to residents at no charge. Certain
services you request through the App — FLX classes, private-dining
reservations, amenity bookings, valet retrievals beyond included
allowances — may be billed to your unit account in accordance with
the building's then-current rate schedule. Any charge is posted to
your statement and may be reviewed with the management office.
Suspension and termination
We may suspend or terminate your access to the Service if:
- You no longer reside at the Tower or your authorization to occupy a unit has ended.
- You have violated these Terms or the building's house rules.
- Your account has been compromised and we cannot confirm your identity.
- Law, court order, or safety requires us to do so.
You may close your App account at any time by contacting the management
office. Closure does not terminate your residency, and certain records
(service history, signed documents) are retained as set out in the
Privacy Policy.
Disclaimers
The Service is provided "as is" and "as available." We make no
warranties — express or implied — that the Service will be uninterrupted,
error-free, or fit for a particular purpose. Information shown in the
App (event details, class schedules, restaurant hours, document
templates) reflects the best information available at the time of
display but may change without notice. We do not warrant the
availability, accuracy, or completeness of third-party services
integrated into or linked from the Service.
Nothing in this section is intended to disclaim a warranty that cannot
be disclaimed under Massachusetts law.
Limitation of liability
To the maximum extent permitted by law, Millennium and its officers,
employees, agents, and service vendors are not liable for any
indirect, incidental, consequential, special, or punitive damages
arising from or related to your use of the Service — including but
not limited to lost data, lost reservations, missed events, or
third-party-vendor outages. Our total aggregate liability to you for
any claim arising out of the Service will not exceed one hundred
dollars ($100) or the amount you have paid us for the specific service
giving rise to the claim, whichever is greater.
This limitation does not apply to liability that cannot be limited
under Massachusetts law, including liability for fraud, gross
negligence, or willful misconduct.
Indemnity
You agree to indemnify and hold Millennium harmless from any claim,
demand, loss, or expense (including reasonable attorneys' fees) made by
any third party arising out of (a) your breach of these Terms, (b)
your violation of any law or the rights of another resident or guest,
or (c) any content you submit through the Service. Millennium will
promptly notify you of any such claim and will not settle without your
written consent, which will not be unreasonably withheld.
Changes to these terms
We may update these Terms from time to time. Material changes will be
communicated to residents through an in-App notice and by email at
least 30 days before they take effect. The "Last updated" date at the
top of this page always reflects the current version. Continued use of
the Service after the effective date constitutes acceptance of the
revised Terms.
Governing law
These Terms are governed by the laws of the Commonwealth of
Massachusetts, without regard to its conflict-of-laws principles. Any
dispute that cannot be resolved informally with the management office
will be brought exclusively in the state or federal courts located in
Suffolk County, Massachusetts.
